Hyderabad: Officials of Central Crime Station (CCS), Hyderabad, on Saturday registered a criminal case against former Andhra Pradesh high court judge Justice N Rammohan Rao and his family members following a complaint by his daughter-in-law accusing them of domestic violence. Joint commissioner of police, CCS, Avinash Mohanty told STOI that cases were registered against Justice Rammohan Rao, his wife Lakshmi and son Vashista after the latter’s wife Sindhu Sharma lodged the complaint with CCS women’s police station earlier in the day.

The cases were filed under sections 498-A (punishment for subjection a married woman to cruelty), 323 (voluntarily causing hurt) and 406 (criminal breach of trust) of IPC and Dowry Prohibition Act against the trio. Sindhu accused in her complaint that she was physically assaulted by her in-laws and husband at their Jubilee Hills residence.

In India, most arranged marriages are largely defined and impacted by the collective will of two families, which makes it a complicated process at times. Traditionally, most arranged marriages are also a meeting of two families that share similarities in terms of their cultural and socio-economic status. Given the weightage given to factors like social status, property, and prestige while deciding whether to proceed with a marriage alliance, families to take into consideration factors such as the financial security of a prospective groom or bride before proceeding with the proposal.

In a recent case pertaining to a matrimonial dispute where the wife claimed Rs 5 lakh per month as interim maintenance, the Bombay High Court held that even if the parents of the wife are rich, it is irrelevant while deciding her application for interim maintenance. The wife, in this case, had challenged a family court order dated 13th May 2016, that had rejected her interim maintenance application.

The husband’s counsel had defended the family court order on several grounds, pointing out that the wife owned or had interest in a luxury apartment that is valued at Rs. 6 crores, but during the time of the court proceedings, she transferred it to her brother for ‘interim’ maintenance and that she owned jewelry worth Rs 1 crore or above.

It was also argued that the wife’s parents are extremely rich and she too has a considerable income of her own as a French tutor. They pointed out that the wife had also not provided a break-up of her expenses while claiming interim maintenance of Rs 5 lakh per month, it was further pointed out.

A pregnant woman will never threaten to commit suicide! So husband’s divorce is thrown out of the window!!

The husband had moved to high court after lower courts refused to grant him divorce.

Holding that the a pregnant wife would not threaten of committing suicide, Bombay High Court has junked a plea for divorce filed by a husband claiming the wife was married to him against her wishes and would always threaten of committing suicide.
Justice Vibha Kankanwadi said, “The reason itself is unbelievable, because wife had become pregnant from the husband. Pregnant lady will not think of taking her life, when she would be giving birth to a life. Except bare words, there was nothing on record brought by the husband. We cannot forget a fact that husband is employed in police and hence it was easy for him to lodge a complaint against the wife.”
The husband had moved to high court after lower courts refused to grant him divorce. It was argued by the husband that “She (wife) tried to commit suicide by self immolation, another time by consuming phenyl. She would threaten him of falsely implicating him and his family in criminal cases. Insisted that husband bring luxurious articles, later she filed criminal case, thereby causing mental agony to him.
The couple had married in 2001, two year after their marriage when the wife was pregnant she moved out of the matrimonial house. Days later the husband served her with a divorce notice. However, it was compromised. Later in 2005, the woman again moved out of the house and since then has been staying separately and a court has directed the husband to pay Rs 9,000 maintenance to her and son.
The bench after going through the entire evidence said, “The husband in this case has not made out the case for irretrievable break down of marriage. It is by his own acts he is keeping the wife away. Further in his cross-­examination he had categorically stated that he is not willing to take the wife along with him. Under such circumstance, when he has no desire, it cannot be said that there is irretrievable break down of marriage.”
