An advocate and his principles – why I do NOT want to become an advocate

Let’s assume for a minute that I become an advocate. And I regularly appear for family court cases ( which is normal considering my past). I would have to be very polite and humble before the family court judge and accept whatever he says. Otherwise he would screw me and make adverse orders against every second client of mine. An appeal of a Family Court degree lies at the doors of a HIGH court & that process takes 5 to 10 years. Yes 5 to 10 years

So even if every second client of mine went on appeal those guys would lose 5 to 10 years . that would be completely unbearable for many of them and especially their parents.

This means I have to keep quite in the face of injustice, say yes sir yes sir three bags full or let my clients suffer.

I just cannot survive in this sort of a system. I’m extremely happy that I never became an advocate in the Family Court system.

Parties are present before this Court.

Thanks to the efforts taken by the High Court of Punjab and Haryana at Chandigarh and Ms. Meenakshi Arora, learned senior counsel   who   graciously   accepted   the   request   of   this   Court   to mediate and further efforts taken by  this Court,  the parties  are ready   to   resolve   their   disputes   amicably.   The   terms   of   the settlement have also been reduced to writing in I.A. No.19210/2018 and I.A. No.19205/2018. We direct that the parties to act in terms of the settlement they have reached.

To   facilitate   the   settlement,   the   following   directions are issued:­

  1. The Estate Officer, Haryana Urban Development Authority (HUDA) is directed to transfer Plot No.934, Sector­27 and   Plot   No.880P,  Sector­27   in   the   joint   name  of   Anu Bhandari/wife and Vibhu Bhandari, minor son. The Estate Officer shall issue the re­allotment letter in terms of this order within 10 days from today.
  2. Mr. Pradip Bhandari is directed to transfer his share in   agricultural   land   situated   in   Khewat   No.159, Khatauni No.176, Khasra 46/2 (20­0) in Village Golpura, Tehsil and District Panchkula as per Jamabandi for the year 2007­2008 left over land owned as on date by Mr. Pradip   Bhandari   in   favour   of   Ms.   Anu   Bhandari/wife, Bhuvi Bhandari and master Vibhu Bhandari.

  3. We   direct   to   Ms.   Anu   Bhandari/wife   to   facilitate   the transfer   by   getting   the   Power   of   Attorney   of   Bhuvi Bhandari, and authorization letter in this regard. As and   when   the   same  are  available,   the   transfer  may  be effected by Mr. Pradip Bhandari/husband.

  4. The   Secretary,   SCBA,   Multi­State   Cooperative   Group Housing Society Ltd is directed to transfer Flat No.1502, Tower 8, SCBA Noida Project Complex, Sector – 99, Noida already alloted to Mr. Pradip Bhandari, in favour of Ms. Anu Bhandari/wife within 10 days from today.

  5. All   the   necessary   expenses   required   for   the   transfer shall be borne by Mr. Pradip Bhandari/husband.

  6. It   is   made   clear   that   as   and   when   the   registration   of transfer is effected, the possession shall also be deemed to have been transfered.

Mr. Pradip Bhandari/husband who is present before us has handed   over   three   drafts   for   a   total   sum   of   Rs.25   Lakhs   (Rs.10 Lakhs in favour of Master Vibhu Bhandari, Rs.10 Lakhs in favour of Ms. Bhuvi Bhandari and Rs.5 Lakhs in favour of Ms. Anu Bhandari) which Ms. Anu Bhandari/wife has duly acknowledged.

Since the parties have reached an amicable settlement of the   disputes,   all   pending   litigations   between   them   and   their families   arising   out   of   the   matrimonial   dispute   shall   remain stayed.

The parties shall also not initiate any fresh litigation without the permission of this Court.

List the matter on 5th March, 2018.
