After evading police for a fortnight in a dowry torture case slapped by daughter-in-law, former Odisha Law Minister Raghunath Mohanty and his wife were arrested on Saturday from neighbouring West Bengal and remanded in judicial custody till April 2.

The former minister and his wife Pritilata were traced after tapping over 50 telephones to an apartment at Betaitola in the neighbouring state’s Howrah district early this morning by the Human Rights Protection Cell (HRPC) of the Odisha police, Director General of Police Prakash Mishra said.

The Mohanty couple had rented two flats since March 20 in the name of different persons.

The senior BJD leader and his wife were brought to Odisha and interrogated at the Chandipur Marine Police Station before being produced in the court, Additional Director General of Police and Chief of HRPC, BK Sharma said.

They were produced amidst tight security before the court of Sub-Divisional Judicial Magistrate Ranjan Kumar Sutar who sent them to judicial custody till April two and also posted their bail application to that date.

The SDJM also sought production of the updated case diary, Additional Public Prosecutor Arun Behera said.

Meanwhile, Chief Minister Naveen Patnaik, who is in Delhi, said the law would take its own course in the case against Mohanty, who had gone into hiding on March 15 after resigning as the Law minister.

Government Deputy Chief Whip Sanjay Dasburma said, “the police action proves that the BJD government never shields anyone. Law has taken its own course. Nobody is above the law in which people should have faith.”

Parliamentary Affairs Minister Kalpataru Das said after his arrest Mohanty should quit the post of BJD vice-president.

The arrest was made on the basis of the FIR filed by Mohanty’s daughter-in-law Barsa Swony Choudhury at the Balasore Town Police station on March 14 accusing the former minister and four members of his family of physically and mentally torturing her for dowry.

Barsa alleged that the Mohanty family had demanded Rs 25 lakh and a luxury vehicle among other things as dowry.

She also accused her husband of having extra-marital relations.

A case had been registered against Mohanty, his wife Pritilata, son Raja Shree, daughter Rupashree and son-in-law Subhendu Madhual under section 498(A) (Husband or relative of husband of a woman subjecting her to cruelty), 506 (criminal intimidation), 448 (trespass) and 34 (common intention) of IPC and section 4 of Dowry Prohibition Act.

Raja Shree was arrested near from Cuttack on March 17 and sent to jail.

As the issue triggered a major controversy and rocked the assembly, ruling BJD leaders, who initially described the case as a family affair, appealed to Mohanty to surrender.

But unable to persuade Mohanty to surrender, the BJD yesterday issued a veiled threat asking him to respect the law or face the consequences.

Mohanty through his lawyer had moved the Orissa High Court seeking quashing of the FIR and also legal protection which were turned down.

Odisha Pradesh Congress Committee President Niranjan Patnaik demanded trial of the case in a Fast Track court, while senior BJP leader B B Harichandan claimed that the arrest followed pressure by opposition parties.

Balasore: The bail application of Raja Shree Mohanty, son of former Odisha Law Minister Raghunath Mohanty, was on Monday rejected for the third time by a court here in a dowry case.

The Sub-Divisional Judicial Magistrate, Balasore, heard the bail petition moved by Raja Shree’s advocate which stated that he was suffering from hypertension while in judicial custody.

The court, however, rejected the plea observing that “there is no change in circumstances,” assistant Public Prosecutor Arun Behera said.


The courts of the SDJM and the district session judge had earlier rejected his bail petition twice on the ground that other accused persons allegedly involved in the dowry torture case had not been arrested so far.

Doctors, on the request of Raja Shree’s petition before the SDJM, had submitted a status report on his health.

Raja Shree, who was arrested on March 17 near Cuttack, was produced before the SDJM court at Balasore by the HRPC on March 18 and remanded to judicial custody for 14 days as his bail plea was rejected by the court.

The police had registered a case under relevant sections of the IPC and the Dowry Prohibition Act against the former minister and other members of his family after Raja Shree’s wife Barsa Swony Choudhury filed an FIR on March 14.

Woman files gang-rape complaint against husband, lawyer

A 25-year-old married woman involved in a matrimonial discord case complained that her husband and three others, including an advocate, gang-raped her in a lawyer’s chamber in a court complex here, police said Tuesday.

The incident was reported around 6 p.m. Monday after the victim telephoned the Police Control Room.

“The victim made the allegation against her husband, husband’s lawyer, a clerk, and her husband’s brother-in-law. A case regarding the incident has been registered after victim’s medical report and probe is on into the incident,” said SBS Tyagi, deputy commissioner of police.

Police were checking the CCTV footage of both the courts and the call details of the woman and others to investigate the case.

The victim told police that she was raped inside a lawyer’s chamber at the Patiala House Court complex Monday evening.

The woman, a resident of Pandav Nagar in east Delhi, said that after marital discord with her husband she had filed a divorce case which was being going on at Karkardooma court in east Delhi.

She alleged that her husband’s lawyer called her at Karkardooma court to settle the issue Monday afternoon, where her husband’s sister and brother-in-law were already present.

“After talking at Karkardooma court for hours, the lawyer asked them to come to Patiala House court. She reached Patiala House court and went to lawyer’s chamber number six where her husband offered her beer which she refused. After that all the accused gang-raped her,” police said, quoting the victim’s complaint.

The accused later threatened her of dire consequences, police said.

Ours was an arranged marriage. However, within a few days, my wife left the house because she suspected my character and alleged that I had an affair with a number of women. How does the question of torture arise when my wife has been staying at her parents’ place for the past seven months? I am shocked at these wild allegations!

How could we have a good conjugal life when we were not even staying together? Her family never supported me. I tried my best to bring her back to my house. We also went to Puri to start afresh, but nothing worked. Time and again, she threatened me, saying that she would commit suicide and put my family behind bars. Her allegations of dowry demands are completely baseless. I am an engineering graduate and have worked with the Vedanta and Tata groups. Only six months ago, I quit my job to dabble in anther profession. I had a good income and I bought a four-wheeler with my hard-earned money. Neither have I ever asked her for a Scorpio vehicle, nor have any extra-marital affairs. I am aware of my family’s social position and would never do anything to tarnish it. However, her familystarted poisoning her mind. Her family has a Congress background and they are using Barsa merely as a pawn to defame my family and me. Honestly, at one point of time, I was scared to bring her back to the house, because I thought if she committed suicide, we would be dragged into myriad problems.

I had never in my wildest dreams imagined that my wife would lodge a case against me. I am going through a period of turmoil. Only a fair probe will reveal the truth.
