BHUBANESWAR: A mob pelted stones at a six-member police team, torched their jeep and snatched away a dowry torture accused from them at a Nayagarh village on Monday night. A few policemen were injured in the attack.

The incident took place at Kalapangi village within Fategarh police limits when the police had gone to the house of Gadadhar Mallick to seize articles allegedly given to him as dowry following a complaint from his estranged wife Sulochana.

Sources said the police had taken Gadadhar’s arrested brother Chhabi, a gram rakhi (village watchman) who is a co-accused in the dowry case, with them. “We did not anticipate any problem because the co-accused is a gram rakhi. But when the cops were busy accounting the seizure, some men threw stones at them, burnt the police vehicle and damaged another van in which the seized articles were being loaded,” said SP (Nayagarh) Seshadev Mallick.

As the injured policemen ran to safety, the attackers fled with Chhabi. A team led by the SP went to the village late in the night to rescue them after they received an SOS call from them. “Police have identified a couple of the culprits and are looking for them,” the SP said. The injured policemen include a sub-inspector, two assistant sub-inspectors, a lady constable, two home guards and the driver.

Police said the accused Mallick brothers have married sisters, Anjana and Sulochana from Gohirpada village. The women have filed separate dowry complaints against their husbands and in-laws. The brothers are accused in both the cases though police went to their house on Monday specifically on the complaint of Sulochana. Police are yet to arrest Gadadhar, who is absconding.

The latest attack on a police party comes over a month after a mob in Sundargarh district killed an ASI and injured four others while they were trying to execute an arrest warrant on August 11. After police apprehended the accused, he had raised an alarm following which villagers gathered and assaulted the group.

Wife files false dowry case, husband granted divorce on grounds of cruelty

Agencies : Mumbai, Sun Sep 23 2012, 11:58 hrs

Filing of false criminal complaints amounts to cruelty under the Hindu Marriage Act, the Bombay High Court observed while granting divorce to a man who was accused of dowry harassment by his wife.

Santosh (name changed) had approached the high court challenging a September 2006 order passed by a family court in Pune dismissing his petition seeking divorce from his wife on the grounds of cruelty.

Santosh had married Rekha (name changed) in November 2001. However, soon thereafter disputes and differences surfaced between the couple. The wife then lodged a complaint of harassment and causing hurt against Santosh and his family with the Pimpri police.

According to the husband, a lower court quashed the criminal complaint filed by his wife after observing that there was insufficient evidence. After this Santosh moved the family court seeking divorce on grounds of cruelty, which was dismissed.

A division bench of Justices V M Kanade and P D Kode after perusing the evidence and judgement of the lower court observed that the complaint lodged by the wife was false in nature.

“In our view, filing of a false criminal complaint itself amounts to cruelty within the meaning of section 13 (i) (a) of the Hindu Marriage Act,” the bench said.

Quashing and setting aside the Pune family court’s order, the high court allowed Santosh’s appeal and granted him divorce.
