AHMEDABAD: City crime branch has concluded that the rape allegations leveled by Vododara based NRG woman against four persons including two police officials are false.

They have found no evidence against the accused and has decided that no FIR can be registered against the persons she has named.

The crime branch will be furnishing the progress report in the case to the Gujarat High Court on Monday. The woman had approached the high court saying that the crime branch was not registering an FIR in her complaint.

Sources said that the complainant did not disclose that she had been raped while she was being subjected to medical examinations twice by different medical officers. Also, she never mentioned about rape to any of her co-accused in a land scam for which she had been in custody of CID (crime).

Despite being summoned thrice, she failed to turn up before the crime branch officials to get her statement recorded, sources added.

The complainant made no reference to the rape even at the time when the magistrate had asked her about any grievances when she was being shifted to judicial custody.

Sources further said that the documents collected from the court do not make any mention about the rape and neither did the complainant ever discuss the issue with the woman constables at the CID (crime) office.

There is no evidence available against the four accused in the case. Sources said that the charges leveled by the NRG woman against two senior police officials and two others have been found to be false. “The call details and the mobile tower locations mentioned do not establish their presence at the alleged spot of crime,” sources said.

Crime branch officials could not get anyone to corroborate the charges leveled by her at the woman barracks of the jail.

Judge penalty balm for dowry victim mother

By GAUTAM SARKAR IN Bhagalpur | – 10 hours ago

A 15-year wait to find the culprits of her daughter’s murder behind bars ended in some sort of consolation for Manju Devi with Patna High Court suspending additional district and sessions judge (Bhagalpur) Radhashyam Sharma.

“The additional district and sessions judge has been suspended following the order of the high court in the wake of the illegal acquittal of all the accused persons in the Kalpana Devi dowry murder case. We received a fax message of Sharma’s suspension late on Friday evening. Sharma was scheduled to retire from his post on July 31, 2012,” Mohammed S. Kausar, the registrar of civil court (Bhagalpur), said on Sunday.

Manju, a resident of Kundi Tola in the Nathnagar area of Bhagalpur city, had earlier accused the court of district and sessions judge of saving the persons who had allegedly killed her daughter for dowry.

Kalpana was married to Binod Rajak of Azamgarh, Uttar Pradesh, on June 9, 1994. Binod’s family had allegedly put pressure on Kalpana’s parents to pay Rs 1 lakh after the marriage despite the latter fulfilling the Rajaks’ demands before the wedding. On June 11, 1997, Kalpana was burnt alive allegedly by Binod and other members of his family. She succumbed to her injuries in a hospital in Varanasi on June 20.

On the basis of a complaint lodged by Kalpana’s father, Surendra Rajak, a case of dowry death (case No- 122/98) was registered. Besides Binod, Kalpana’s mother-in-law and brothers-in-law were named accused.

According to sources in the civil court, the case (Session case No- 273/2001) was being heard in the court of the additional district and sessions judge, Bhagalpur. On June 17, 2012, Sharma in his order acquitted Binod, his elder brother, Mohan Baitha, younger bothers Alok and Yogendra and mother Shyama Devi from the charges of killing Kalpana for dowry.

“Earlier, the prosecution side had urged the court to hear one Gulabi Rajak as a witness. But without considering the request, the court had imposed a fine of Rs 2,000 on the additional public prosecutor,” said Sanjay Kumar, the additional public prosecutor representing Kalpana’s parents. He added that Manju Devi had applied before the court on June 13, 2012, so that she could file a revision petition against the incident in the high court.

In the wake of the lower court’s verdict, Manju Devi on June 20 registered her complaint with the Supreme Court and the high court against Sharma. She alleged that during the judgment, not a single accused was physically present in the court. “More interestingly, a lady advocate from the defence side used to move the case through she did not sign on the power earlier in the case,” she alleged in her complaint.

On learning the latest development, Manju said: “I hope that the culprits who are on bail now would be punished for killing my daughter.”

Kerala is picking up steam : “….2,364 cases have been reported in the state till May 2012 in connection with cruelty by husband or relatives…”

“….As per the statistics, 2,364 cases have been reported in the state till May 2012 in connection with cruelty by husband or relatives, while it was 5,377 cases in 2011, 4,797 in 2010, 4,007 in 2009 and 4,138 in 2008…..”

it is just considered as “….Women have become bolder enough to come forward and lodge complaints,……….”

State sees a spike in crime rate

TNN | Jul 30, 2012, 04.30AM IST

KOCHI: Well, it seems like Kerala is in a race to beat its own crime rate figures of 2011, 2010, 2009 and 2008. In the first five months of year 2012, the state has already witnessed 151 murders that included the brutal killing of RMP leaderT P Chandrasekharan at Onchiyam. While the murder figures (up to May 2012) were 151, the number of attempt to commit murder, rape and dowry deaths were 236, 432 and 17 respectively.

A fair reading of the stats released by the Kerala Police shows that there is a drastic increase in number of dowry deaths (17 cases so up to May) in 2012 compared to total 15 cases in 2011.

“We register dowry death cases after conducting preliminary investigation on the complaints given by the relatives of the victim. Though most of the incidents prima facie look likes suicide, probe has brought out the real cause of deaths,” said a senior police officer.

As per the statistics, 2,364 cases have been reported in the state till May 2012 in connection with cruelty by husband or relatives, while it was 5,377 cases in 2011, 4,797 in 2010, 4,007 in 2009 and 4,138 in 2008.

“We register all the complaints forwarded by victims after conducting a preliminary probe. Even in the incidents of molestation or sexual harassment, we entertain the victims to lodge a formal complaint,” the officer said and added that as years go by, the crime rate is likely to increase and not decline. “Women have become bolder enough to come forward and lodge complaints,” he said.

According to the data, of the 124 kidnapping and abduction cases reported in the state up to May 2012, 88 cases were kidnapping of women.

The statistics relelased by Kerala Police shows that there is a drastic increase in number of dowry deaths.

34-year-old cop held for hoodwinking widow into marriage

Mahender Singh Manral | New Delhi

A 34-year-old Delhi Police personnel, posted with a Delhi Police Training school at Malviya Nagar, was arrested for illegal second marriage with a widow.

A case under Sections 120B, 307, 406, 417, 493, 495, 496, 498A, 506, 509 of the IPC was registered at Safdurjung Enclave police station of South Delhi.

The arrest was made following on a complaint filed by a 29-year-old widow Sangeeta. In her complaint, Sangeeta alleged that the accused had fraudulently got married with her to extract the compensation money, which she had received after her first husband death.

A senior police official said that the complainant lost her first husband in a road accident after a year of her marriage. Later, she met the accused Kumar at Kalkaji temple where he was deployed. “The victim used to meet Kumar to discuss the issue of pending MACT compensation. In the process, a relationship developed between them. He had proposed her to marry him. However, Kumar did not reveal that he had already married,” added the police.

On September 27, 2004, their marriage was solemnised at All India Hindu Mahasabha Parishad in Mandir Marg area. Before the marriage ceremony, the accused was asked by the Mahasabha staff to provide an affidavit on his marital status. Later, Kumar had submitted the affidavit stating that he was a bachelor.

“After the marriage, they stayed in a rented accommodation at Jasola Vihar and she gave birth to a child a year later. After a year or two, he started harassing her asking for more cash and dowry from her parents,” said an official.

Sangeeta told the police that she had received compensation money for her first husband’s death in 2006. From the compensation money, Kumar had taken `3.50 lakh to purchase a flat in Arjun Nagar. She had also given him a car after he threatened that he would kill her along with her son if she did not do the same. In her First Information Report (FIR), Sangeeta said, “I gave him around `3,50,000 and purchased a flat in Arjun Nagar and also had purchased a car for him.”

In 2008, Kumar suddenly went missing. Sangeeta had lodged a missing complaint with Okhla police. However, after some months, she came to know that the accused was residing with his first wife in Govindpuri area.

“After knowing the reality, she approached the police in December, 2008 and lodged a complaint against Kumar cheating her. She sought appropriate legal action against the accused,” added the official.

After Kumar got to know police complaint, he tried to strike a deal with her. However, she refused to relent.

Even after two years, the Delhi Police did not take any action against the accused, she moved a city court. Following the court’s order on May 19 this year, a case was registered at Safdurjung police station against Kumar.

“After probing the matter, Kumar was arrested from his residence in Govindpuri area on July 28,” said an official.
