Yes, I mean that
the very fear / the very problem of maintenance revolves around the following
1. what is the wife claiming as maintenance ?
1.1. say wife is claiming Rs 50,000 per month, but husband is earning only Rs. 20,000 a month …. obviously hubby has expenses out of 20 k earnings and wife can’t get crazy amounts ….
1.2. Use proof of (husband’s) earning to fight case and reduce maintenanec to Rs 5000 [FIVE thousands] a month (1/10 of what is claimed) or something like that
1.3. MORAL OF the story : do NOT worry about anything else other than the maintenance claimed, proof of earnings presented , PROOF available with wife, what can be reasonably won and what cannot be won
1.4. In above example do NOT assume that Zero maintenance will be possible. judge will ask for your salary slip and levy some maint IF wife is completely un employed ; if wife is employed use that proof to reduce maintenance
1.5. also do NOT assume that IF full proof is provided, and case is properly argued, judge will decree everything to wife and bankrupt the hubby…. does NOT happen in 90+% of cases
1.6. if a crazy decision is imposed by lower court, pay first month maint and go on appeal
2. what is the / what are the proofs in the hands of the wife ?
2.1. say wife say my husband is the owner of the nearby spinning mills and he is a crorepathy
2.2 say in reality that spinning mill is owned by some one else and husband is just working there
2.3. provide just sufficient proof (say your salary cert + some paper cutting …all as examples) to refute wife’s claims
2.4. again do NOT assume that Zero maintenance will be possible
2.5. judge will ask for your salary slip and levy some maint IF wife is completely un employed
3. what are the counter strategies with the husband
3.1. is wife employed ? what proof ?
3.2. Is wife deserting the husband ? if yes, what proof ?
3.3. try every possibility to reduce
….etc….etc…
4. how far is the husband willing to fight back ?
4.1. Is husband ready to say … I don’t care about divorce, ready to wait for ever ?
4.2. In a husband in a hurry to run and get married again ?
4.3. is husband / wife in some other relationship ??
…etc…..etc…
5. so a lot of planning , mental preparation and understanding of relative positions is needed
6. Where should one start : Obviously read blogs, read cases laws, …but nothing like personal contact : attend national rallies, dharnas, weekly meetings to mix with senior and ask all question IN PERSON
7. network ….network and network with other similar husbands
8. there was a member here who was from a businessman family, wife was an airhostess and they divorced and the male paid just for the kid and probably nothing else, even though he is probably a crorpathy
9. there are other members here who come and cry that the lawyer scr#w#d them
10. so a lot depends on what you do
11. DO NOT …..REPEAT DO NOT panic and sell your assets in distress prices
12. in many cases it is better to be in business than in employment as business income is harder to decipher than salary income (which can be easily computed from a payslip )
Of course it is best to be UN MARRIED !!! but well that depends on how far men can hold their horses !! 🙂

Dear Seniors,
We all know when there is a conflict between Husband & Wife, the residential property of Husband generally comes in trouble & many a times Seniors/experts suggest to dispose off/transfer husband’s property to some one else. I have the below question. Need suggestions of experts.
SITUATION:
1. Divorce & Dowry /interim maintenance etc cases are in progress for around 2 years.
2. Husband is the owner / shareholder of the company & having a _______ (property / assets) in his company’s name.
4. 498a wife is working in __________________
QUESTION:
1. Is there any threat to this property also ?
2. Can 498a wife raise demand only on the Husband’s residential property OR can get the Factory Property also attached in the case ? Though the value of the factory is not too high, but thought to take your valued opinion. Kindly suggest & give your recommendation pls.
